1. Acceptance of Terms

By accessing or purchasing from our online store ("the Site"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all visitors, customers, and anyone who accesses or uses the Site. If you do not agree to these Terms, please do not use this Site or place an order.

Eyeconic Arizona Souvenir Shop is operated by Eyeconic Prints LLC, located at 1745 East McDowell Road, Phoenix, AZ 85006. By making a purchase, you confirm that you are at least 18 years of age or are accessing the Site with the consent and supervision of a parent or legal guardian.

2. Products and Pricing

We offer Arizona-themed apparel, souvenirs, gifts, and lifestyle products. All products are subject to availability.

Prices are listed in U.S. dollars (USD) and are subject to change without notice.
We reserve the right to limit quantities, discontinue products, or correct pricing errors at any time.
Product images are representative and may vary slightly from the final item due to screen calibration, printing processes, or product variations.
Apparel sizing charts are provided on each product page. Please review them before ordering, as sizes may vary by manufacturer.

3. Orders and Payment

When you place an order, you are making an offer to purchase the selected product(s). We reserve the right to accept or decline any order at our sole discretion.

Order Confirmation: You will receive an email confirmation after placing your order. This confirmation does not guarantee shipment.

Payment: We accept all major credit cards and payment methods supported through our checkout platform (Shopify). Payment is processed at the time of purchase. All transactions are encrypted and secure.

Order Cancellations: Orders may be cancelled within 24 hours of placement by contacting us at order@eyeconicprints.com. After 24 hours, orders may already be in production or fulfillment and cannot be cancelled.

4. Shipping and Delivery

Domestic Shipping: We ship to all 50 U.S. states. Estimated delivery times are provided at checkout and are estimates only — not guarantees.

Processing Time: Most orders are processed within 2–5 business days. Custom or print-on-demand items may require additional production time.

TikTok Shop Orders: Orders placed through TikTok Shop are fulfilled under TikTok's Upgraded Shipping Program. Shipping timelines and carrier selections for TikTok Shop orders are governed by TikTok's shipping policies. We are not responsible for shipping delays, carrier issues, or lost packages on TikTok Shop orders — please contact TikTok Shop support directly for those orders.

Lost or Delayed Packages: Once a shipment is handed off to the carrier, Eyeconic Arizona is not responsible for carrier delays, lost packages, or delivery errors. Please contact the carrier directly with your tracking number. If a package is confirmed lost by the carrier, contact us and we will work with you to find a resolution.

5. Returns and Refunds

We want you to love your Arizona-proud gear. Here's how we handle returns:

General Merchandise (non-custom items):

Returns are accepted within 30 days of delivery.
Items must be unworn, unwashed, and in original condition with tags attached.
To initiate a return, email order@eyeconicprints.com with your order number and reason for return.
Customers are responsible for return shipping costs unless the item is defective or we made an error.

Defective or Incorrect Items:

If you received a damaged, defective, or incorrect item, contact us within 7 days of delivery with photos of the issue.
We will provide a replacement or full refund at no cost to you.

Non-Returnable Items:

Custom or personalized items are non-refundable unless defective.
Final sale items are non-returnable.
Gift cards are non-refundable.
Food and consumable items are non-returnable for health and safety reasons.

Refund Processing: Approved refunds are issued to the original payment method within 5 to 10 business days of receiving the returned item.

6. Intellectual Property

All content on this Site — including but not limited to logos, brand names, product designs, the Eyeconic Arizona mark, the Arizona Sasquatch character (Albert), photography, graphics, and written content — is the property of Eyeconic Prints / Eyeconic Arizona and is protected by applicable copyright and trademark law.

You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content from this Site without our prior written permission.

7. User Conduct

By using this Site, you agree not to:

Use the Site for any unlawful purpose
Attempt to gain unauthorized access to any part of the Site or its systems
Submit false, misleading, or fraudulent information
Engage in any conduct that could damage, disable, or impair the Site's functionality
Use the Site to transmit spam, malware, or harmful content

We reserve the right to terminate access for any user who violates these Terms.

8. Third-Party Links and Platforms

Our Site may link to or embed content from third-party platforms (including TikTok Shop and Shopify). We are not responsible for the content, privacy practices, or terms of any third-party services. Links to external sites do not constitute endorsement.

9. Disclaimer of Warranties

To the fullest extent permitted by law, Eyeconic Arizona disclaims all warranties, including implied warranties of merchantability and fitness for a particular purpose.

To the maximum extent permitted by law, Eyeconic Arizona and Eyeconic Prints shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Site or purchase of any product. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Maricopa County, Arizona.
